A cargo owner provides cargo details mentioned bellow to a shipbroker who finds suitable ships or directly to owner of ship :

After meticulous checkings of the ships, the charterer chooses a ship, and via the broker and makes a FIRST OFFER.

The initial offer includes charter/freight rates and other conditions

The Cargo owner either accepts or rejects the offer

Further offers and accepting the rate & mentioned conditions may lead to a charter being FIXED, i.e. the shipowner and the charterer agree to the charter, and a CHARTER PARTY (a special document which is eqaaul to official contract) is signed by the owner and the charterer.

 All details in the charter party govern the chartering process.

Similarly, a shipowner may use the services of a shipbroker to find cargo for his ship this procedure is the same as outlined above

Bulk carriers such as dry bulk carriers loading iron, ore, etc. are usually chartered to move specific cargoes

Some details that are included in the charter party

  • Full Name and (IMO) number of the ship
  • Date of beginning and end of charter process
  • Port (or Berth Name- specified by number) where the charter begins.
  • Port (or dock specified by number) where the charter will end.
  • Laycan date: the Timezone when the ship must be at a particular place and be ready to load or discharge
  • Cargo to be carried (for voyage or time charters)
  • Insurance details
  • payment details & chages
  • Laytime agreement.

Definitions

  • Laycan – The dates between which a ship must be a given place as agreed in the charter party to start her charter and be ready to load cargo

Note: If the ship is late, the charter can be cancelled or renegotiated.

 If the ship is early, the shipowner is responsible for all costs up to the starting date and time of the charter.

  • Laytime – The agreed number of hours that will take to load or discharge a ship.In charterparty it is specified if the process or Loading or Discharge takes more time than agreed, the charterer pays the shipowner an agreed amount per hour and minutes of delay, which is called demurrage.
  •  If the cargowork takes less time than agreed, the shipowner pays the charterer an agreed amount per hour, which is called dispatch.
  • Rain during loading a weather-sensitive cargo (e.g. cement or grain) or a strike among shoreside workers would not be subject to demurrage of dispatch and according  captain order or decision.
  • Notice of Readiness – When the ship has arrived at a given place to start the charter, the holds must be ready to receive the cargo. They should be clean and dry. The Master issues to the charterer a notice of readiness that his ship is ready to load.
  • The charterer sends a surveyor to check the condition of the ship,If the condition of the ship is satisfactory, the surveyor will inform the charterer and instructions will follow that loading can started by chief manager.
  • If the surveyor finds that the ship has deficiencies and cannot start loading, he will list the deficiencies and refuse to allow loading to start until the deficiencies have been put right
  • Normally the loading process starts after the custom formalities has finished in load Port otherwise,the loading process stops and the delay causes demurrage.

There are numerous  risks associated with chartering an vessel. A vessel obviously has expensive fixed costs and therefore must protect their investment.

1.INQUIRY (MARKET ENTRY)

A.An inquiry shall be sent simultaneously to all the brokers & Ship-owners through email,In order to inform ship owners about our inquiry

Write an official (LOI) for vessel charter with bellow format on your company letterhead:  Dear Sir,

Ship-owners / brokers will  send  offers till the specified time/date indicated in the inquiry

 (A) Technical Evaluation For all the valid offers, technical evaluation  means workability vessels.

(B) Commercial Evaluation :After establishing the workability of the vessels, commercial evaluation shall be made on the basis of ‘Freight’ quoted ,Demurrage rate,Discharge rate and other terms & conditions will also be negotiated.

2. NEGOTIATIONS:

Negotiations will be held with cargo owners or their respective ,Whereas a ‘firm’ counter will be given During negotiations, the bidders can change the rate depending upon their response

In case, agreement is not reached, the broker will  explore other alternative

In case, negotiations are successful with the foreign ship-owner, broker company  will be asked to match the rate with the foreign ship-owner.

3.FIXTURES ON SUBJECTS :

After concluding the negotiations, the ship fixture will be confirmed on ‘subjects’ with a time schedule to carry out the following activities :

a) Charterer’s  approval

b) Supplier acceptance

c) Confirmation of cargo  from user

d) Obtain Fixture Note from the broker / owner for record

4. CHARTER PARTY

On receipt of supplier approval and cargo confirmation, the ‘subjects’ will be lifted and the vessel will be clean fixed.

Clean Fixture will be received from the broker/ship-owner and following charter parties shall be used:

 a. Voyage Charter

b. Time Charter

What is a FNOTE or Fixture Note in charter?

The fixture note signed by both parties is identically a simple chartering contract which is performed by both parties. After signing the fixture note, the shipowner compiles the formal chartering contract according to the agreed terms, and sends it to the charterer for verification through the chartering agent or broker.
